Terms of Service

Welcome to ItemsField ("we", "us", or "our"), a classified listings marketplace connecting buyers and sellers across Nigeria. These Terms of Service ("Terms") govern your access to and use of the ItemsField website and any related services (collectively, the "Platform").

By creating an account, posting a listing, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please stop using the Platform immediately.

You must be at least 18 years old to create an account or use the Platform. By using ItemsField you represent that you are 18 or older, have the legal capacity to enter into a binding contract, and are not prohibited from using the Platform under applicable Nigerian law or any other jurisdiction that applies to you.

To post listings or message other users you must register for an account. When registering you agree to:

• Provide accurate, current, and complete information.
• Keep your account credentials confidential and not share them with any third party.
• Notify us immediately at [email protected] if you suspect unauthorised access to your account.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that contain false information or that we reasonably believe have been compromised.

ItemsField allows users to post classified advertisements ("Listings") for goods and services. When posting a Listing you agree to:

• Ensure all descriptions, prices, photos, and other details are accurate and not misleading.
• Only advertise items or services that you own or are authorised to sell.
• Keep Listings up to date and remove or mark sold items that are no longer available.
• Post each item in the most relevant category and location.

We may remove any Listing at our sole discretion without notice if it violates these Terms or is otherwise deemed harmful to the Platform or its users.

You must not post Listings for, or otherwise use the Platform in connection with:

• Illegal goods or services, including stolen property, counterfeit items, narcotics, weapons, or wildlife products prohibited by Nigerian law.
• Fraudulent, deceptive, or misleading advertisements or communications.
• Harassment, threats, hate speech, or any content that discriminates based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
• Adult or sexually explicit content.
• Spam, unsolicited bulk messages, or pyramid schemes.
• Any activity that attempts to reverse-engineer, scrape, or disrupt the Platform's infrastructure.
• Impersonating another person or entity.

Violation of these rules may result in immediate account suspension and, where required by law, referral to relevant authorities.

ItemsField is a connection platform that brings buyers and sellers together. In most cases, deals and payments are arranged directly between buyers and sellers off the Platform — using the phone numbers displayed on profiles and listings — with no involvement from ItemsField.

However, where trust between a buyer and seller is a concern, ItemsField may, at its discretion and upon agreement by both parties, step in to hold payment on behalf of the buyer until the transaction is satisfactorily completed. In such cases:

• Both parties must explicitly agree to ItemsField's involvement before any funds are transferred.
• Funds will only be released to the seller once the buyer confirms receipt and satisfaction, or after an agreed resolution period.
• ItemsField acts solely as a neutral intermediary and does not take ownership of the goods or services being exchanged.
• Any fees applicable to this intermediary service will be clearly disclosed before the parties commit.

Regardless of the payment arrangement, ItemsField does not:

• Guarantee the quality, safety, or legality of any item.
• Guarantee that a buyer will complete a purchase or that a seller will complete a sale.
• Verify the identity of every user.

ItemsField strongly recommends:

• Meeting in safe, public, well-lit locations for in-person deals.
• Inspecting items carefully before handing over any payment.
• Keeping a record of all communications.
• Never sending money directly to someone you have not met without using ItemsField's intermediary service or another trusted escrow mechanism.

Basic use of ItemsField — including account creation and posting standard Listings — is free of charge. We may offer optional paid features such as promoted Listings, verified seller badges, or store subscriptions. Pricing for any paid feature will be clearly displayed before you are charged.

All fees are stated in Nigerian Naira (NGN) unless otherwise indicated. We reserve the right to modify our fee structure at any time with reasonable prior notice.

All content on the Platform that is created by ItemsField — including logos, design, software, and written content — is the property of ItemsField and is protected under applicable Nigerian and international intellectual property laws.

By posting a Listing or uploading any content you grant ItemsField a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content solely for the purposes of operating and promoting the Platform. You retain ownership of your content. You represent that you own or have the necessary rights to the content you submit.

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect your personal information in accordance with the Nigeria Data Protection Regulation (NDPR).

The Platform is provided on an "as is" and "as available" basis without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We reserve the right to modify, suspend, or discontinue any part of the Platform at any time.

To the fullest extent permitted by applicable law, ItemsField and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the Platform shall not exceed the amount you paid to us (if any) in the twelve months preceding the claim.

You may close your account at any time by visiting Settings and selecting "Delete Account". We may suspend or terminate your account and access to the Platform at our sole discretion, including for breach of these Terms, without prior notice or liability.

Upon termination, provisions of these Terms that by their nature should survive (including intellectual property, disclaimer, limitation of liability, and governing law) shall continue to apply.

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Nigeria.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. For material changes we will provide additional notice, such as an in-app notification or an email to the address on your account. Your continued use of the Platform after any changes constitutes acceptance of the revised Terms.
